Braintree Prohibited & Restricted Businesses List

As of 2026-08-07, Braintree's published terms name 53 business categories as prohibited and 6 as restricted. The full list is below, grouped by status, with the exact policy language for each category. Braintree's Acceptable Use Policy, last updated November 8, 2017, bars six broad restricted activities in Section 1 and then lists 59 specific business categories in Section 2. Most categories are banned outright, while a handful (airlines, gambling in some countries or regions, memberships over one year, personal computer tech support, tour operators, and travel agencies or clubs) note that exceptions apply if you get Braintree's prior written approval.

FAQ

Common questions about Braintree's list.

Does Braintree allow high-risk businesses like adult content or supplements?

Braintree's Acceptable Use Policy prohibits "sexually-oriented or pornographic products or services" and "pseudo pharmaceuticals" outright, with no approval pathway listed. Merchants in adult content or supplement niches that fall under those categories would typically need a high-risk merchant account from a provider that underwrites those industries instead.

Which Braintree categories can get prior written approval?

Six categories in the policy carry an exceptions clause tied to Braintree's prior written approval. They are airlines, gambling (in some countries or regions), membership subscriptions longer than one year, personal computer technical support, tour operators, and travel agencies or travel clubs. Everything else on the Section 2 list is prohibited with no exception language.

Does Braintree allow CBD or cannabis businesses?

The policy prohibits "marijuana dispensaries and related businesses." CBD and hemp products are not named separately in the policy, so a CBD merchant would need to confirm directly with Braintree whether it treats CBD as a related business. It also prohibits drug paraphernalia as its own category.

What happens if Braintree decides my business violates its Acceptable Use Policy?

Section 3 of the policy gives Braintree sole discretion to act with or without notice. Possible actions include blocking settlement of payments, suspending or terminating your access, terminating the business relationship, taking legal action, disclosing information to banks, card networks, or law enforcement, and charging you for resulting fees and penalties.

How current is Braintree's prohibited business list?

The published policy shows a last-updated date of November 8, 2017, and Section 4 says Braintree can amend it at any time by posting a new version to its website. Continued use of the payment services counts as agreement to the amended terms, so it is worth checking the live page before applying.

On the list?

Braintree won't board your category. We underwrite the legal ones.

Midnight Payments approves high-risk businesses with category-aware underwriting, low or no monthly fees, no long-term contracts, and daily ACH settlement. And if a shutdown already happened, a MATCH or TMF listing still has options.
